Please read these terms and conditions carefully before completing your reservation. By completing a reservation you will enter into a binding contract on the basis of these terms and conditions. If you have queries please contact us prior to completing your reservation.

TERMS & CONDITIONS

1. DEFINITIONS

The terms “host” or “artists” refers to the informal collaboration of artists composed of Daniel Allison, Kirsten Milliken, Aron Hegarty, Sorcha Hegarty, Danica Boyce and Sam Gillepsie, working together to deliver a retreat. “Client” refers to the person or persons named on the registration form, “retreat” and “event” refers to a residential retreat delivered by the artists. “Registration form” refers to the event registration form.

2. HOW THE CONTRACT IS FORMED BETWEEN US:

a) After completing payment for the event the hosts will contact the client requesting completion of the registration form. 

b) On receipt, by the host, of the full payment of the fee and completion of the registration form the hosts will send confirmation of acceptance onto our retreat via email. 

c) The hosts reserve the right, in their absolute discretion and without the need to give reasons, to refuse to accept a reservation. In such circumstances no agreement arises and the hosts will return any payment made for the event.

d) The agreement is between the hosts and the client and is the sole agreement between those parties. No variation of these terms and conditions shall be applicable unless confirmed in writing by the hosts before the retreat.

By completing the reservation the client shall be deemed to be agreeing to these terms.

3. PAYMENT

a) Payment must be made at point of sale via the House of Legends website, unless otherwise agreed in writing by the hosts. 

b) If payment via another method is agreed and the balance is not paid in time, the hosts reserve the right to treat the agreement as cancelled by the client pursuant to clause 5, below.

4. ADJUSTMENT OF FEES

Whilst every effort is to limit the fee to that quoted at the time of reservation, the hosts reserve the right to adjust the fee should the cost of hosting an event increase for reasons beyond its reasonable control.

a) In the event that a fee is altered the client will be notified as soon as reasonably possible and the balance of the altered price will be payable on the same terms as the original fee.

b) In the event the fee is increased by 10% or more the client may opt to cancel the booking and will then be entitled to a full refund of all monies paid.

5. CANCELLATION BY THE CLIENT

If the booking is cancelled by the client (for any reason) the following charges will arise:

a) Cancellation more than 8 weeks before the event starts, 50% of the fee will be refunded assuming it has been paid. 

b) Cancellation 8 weeks or less before the event, the fee is non-refundable.

c) In the event of an early departure or drop out by the client from the retreat after it has commenced, no refund will be given.

The client acknowledges that it is reasonable for such penalties to arise given the need for the hosts to make preparations for a retreat substantially in advance of the start date.

6. CANCELLATION/ALTERATION OF A EVENT BY THE HOSTS

In the unlikely event that a retreat is cancelled by the hosts before it starts:

a) The hosts, in their absolute discretion and without need to give reasons, reserve the right to cancel a retreat and will give as much notice as reasonably possible to the client. In the event of cancellation by the hosts, the client will be offered a full refund of all monies paid for the retreat or the opportunity to participate in a comparable retreat on another date.

The client acknowledges that there may be circumstances in which this may occur and accepts that the artists are not liable for any losses arising as a result of cancellation.

7. PERSONAL CONDUCT DURING PARTICIPATION IN OUR RETREAT

a) The client acknowledges that during the retreat, he/she is required to submit to the reasonable instructions and leadership of the artists leading the activities.

b) The client acknowledges that all persons attending a retreat are entitled to expect a high standard of conduct and regard for personal well being on the behalf of all clients. For this reason the client accepts that the hosts may, in their absolute discretion and without the need to give reasons, arrange for him/her to be removed from a retreat, if necessary against his/her will. Circumstances in which this might occur include (without limitation) disorderly or abusive conduct; intoxication; inadequacy of clothing or equipment; failure to follow preparation instructions that, in the opinion of the host, presents a risk to the clients own health and safety or that of others. In such circumstances the client will not be entitled to a refund of monies paid for the event and the hosts will not be liable for any losses resulting. The client will also on demand reimburse the hosts for any reasonable costs incurred in effecting his/her removal from the retreat.

8. PHOTOGRAPHY

a) The hosts may occasionally take photographs during our retreats which may include photographs of participants, these are the property of the hosts and may be used for marketing and publicity purposes. Clients are assumed to give their permission for their photographs to be taken by the artists unless stated in writing to the hosts before the event.

9. LIABILITY

a) The Dreaming of Oak & Ash retreat is a wilderness retreat that takes place in the open countryside and by its nature is not free of hazards. The hosts will make every effort to minimise risks to the clients health and safety and will instruct clients in the safe negotiation of any such risks as may remain. Consequently, the client acknowledges that there are circumstances in which an accident could befall a client without the artist being at fault and accepts that he/she is taking part in the retreat at his/her own risk.

10. INSURANCE

a) The client is strongly advised to take out personal insurance of the type available to holiday makers, to cover the risks ordinarily covered by such policies, including personal injury, loss of belongings and money and cancellation of the event.

11. COMPLAINTS PROCEDURE

a) In the unlikely event that a client has cause for complaint about a retreat, the complaint should be made to one of the hosts during the retreat in order that corrective action can, if necessary, be taken as soon as reasonably possible. 

b) The client acknowledges that it is unreasonable to take no action during the event but to complain later. However should a problem not be resolved, a complaint should be made in writing within 28 days of the relevant event. To the extent permitted in law, the hosts will not be liable in respect of claims first intimated later than 28 days from the close of the relevant retreat.
